Medical Powers of Attorney Forms with HIPPA Provisions Now Available.
Older Medical Powers of Attorney Forms Should Be Updated.
In early 2006, the Colorado Bar Association, Committee on Estate Planning, released their adopted uniform language for HIPPA provisions in their Medical Power of Attorney forms. Previous forms not containing those provisions were subject to rejection by health care providers when applied to certain situations. HIPPA (the Federal Act protecting the privacy of information) created an unintended consequence where certain powers of attorney were considered to be noncompliant with the act. Over the course of several years the issue was addressed on a piecemeal basis by individual lawyers and healthcare providers. Having no focused consensus of acceptable provisions, the resulting confusion in the healthcare and legal communities only compounded the problems facing clients. As a result of the committee's work, uniform language considered acceptable to members of the healthcare industry and legal community was agreed upon and is now implemented in all Medical Powers of Attorney documents prepared by Jerold R. Gilbert Law Offices, P.C.
