Buying a home is easily the single largest purchase most of us will ever make in our lifetime. Buying a home is a complicated process demanding competent legal counsel looking after YOUR interests.

For any real estate purchase, whether a residence, vacation property, rental property or real estate investment, the contract for purchase is a complex and detailed document. That contract will have lasting affects upon the quality of your investment. Always have the contract reviewed by YOUR counsel, before you sign it. Don't rely on advice from realtors, mortgage brokers, title companies or anyone else. Despite their best intentions, their interests are different from yours and accordingly, their advice can never be in YOUR best interests. Always have your attorney review any real estate document BEFORE you sign.

As your lawyer, let me review the contract before you sign.  Once a contract becomes binding, its terms control the transaction.  You may want to change them while you have the opportunity.  Correction after the fact may be impossible and efforts to do so can be costly and ineffective. 

Title Issues:   I represent clients facing a variety of title issues. I assist clients in the title review process conducted prior to closing. This is a very important part of the sale transaction. This is a critical time where legal counsel is vital to your successful  acquisition and many a buyer have been "surprised" after the fact because they neglected to address the details revealed in the title commitment. My job is help you avoid those "surprises".

In addition there are times where you must make a claim against a title insurer.  Something went wrong and now someone is making a claim against your ownership interests to the property. Even title companies make mistakes.  I will review, consult and assist you with the steps necessary to resolve those issues. 

Probate/Estates and Title Issues May Overlap:

A possible connection between the legal, real estate and even mortgage brokerage worlds is a unique situation involving probate.

Typically, this situation arises regarding an elderly married couple.  They bought their home many years ago and simply believed they held title as joint tenants.  One spouse dies.  The remaining spouse (let’s say the wife) assumes everything was in joint tenancy and does nothing regarding the deceased spouse’s estate.  The typical dialogue goes something like this:

“I didn’t do anything because, well... after all, everything is in joint tenancy and automatically goes to me, right?  I didn’t want to get a lawyer involved as that costs money… it takes time… and anyway, my friend’s nephew said we didn’t need to do anything…. He sells prepaid legal you know …he’s very knowledgeable about legal matters…he’s soooo wonderful!”

A few years go by and the surviving spouse is now downsizing or the family is taking steps to move her into assisted living or a nursing home.  The house is under contract for sale and closing is scheduled in a week or so. Then suddenly, the title commitment reveals an existing undivided one-half interest in the subject real estate retained by the deceased spouse.  30 years ago the couple took title as "tenants in common" and although they intended to convert it to "joint tenancy", just like a lot of things, they never got around to it.  As a result, the title is clouded and the sale is now jeopardized.  The deceased spouse’s interest must be conveyed to the seller in order to perfect title and allow closing.

The solution is to file a probate of the deceased spouse’s estate and clear the title.

That's what I do.  The key is a quick response.  I’ve been very effective in working rapidly in these situations... I've even saved a few closings.  Oh, and by the way..... stop getting your legal advise from salesmen, whether they're "wonderful" or not.
